The Legal Process in North Carolina
Filing a lawsuit can be the appropriate course of action to take in order to resolve a dispute, particularly in instances where there has been a breach of contract or negligence leading to injury. It is best if the Plaintiff can sufficiently determine that certain elements are in place before proceeding with a lawsuit and this is where the assistance of a good lawyer can be beneficial. In the end, having a case heard by a jury of peers can be the best way to resolve a case.
Summons and Complaint
The lawsuit process starts with the Plaintiff's attorneys filing a Summons and Complaint at the Clerk’s office, which is then served to the Defendant by the Sheriff or by certified mail.
Answer to the Complaint
The Defendant has thirty days to file an Answer to the Complaint and the Defendant's lawyer may request an extension of 30 additional days. A Reply to the Answer may be filed.
Discovery Phase
This is where each side is allowed to request production of documents that the other side possesses. This can take several months to complete.
Mediation
A date & time is scheduled for all lawsuit parties, including a court-appointed mediator, insurance adjustors or others, to determine if the lawsuit can be settled before going to trial.
Trial
A particular month and week will be determined for the trial, but the actual trial could take place on any day of that week, or be pushed to a later date.
